the drama continues from the whole overgraded thingy.
He says himself, that his "cousins boss" didnt receive any comics from her. She didnt ship them out because he stopped payment on the check before she shipped.
This is the feedback that the guy who did not receive any comics left for every auction.
The story is unfolding. I knew there was more to it. Doesnt mean the first guy didnt get a bunch of overgraded crap. But, there is definately a teamed up offense on the seller.
So, the second account that i figured to be the same person isnt the same person, but is linked.The owner has made an offer, it is the only one you'll get - I don't agree with it, but it's his choice. His offer is this: Mutual withdraw of feedback, and I will take a handful of comics, unsearced, etc out of one of the boxes (there are 6000+ comics) and send you that handful - as is - and that will be the end of it. I figure I can fit between 10-14 comics in a handful. Let me know Oh - and BTW - I have messaged affidavits from other ebayers you contaced which is against ebay terms of service, I will also not act on those.

SHE DECLINED SO I PLACED A STOP PAYMENT ON THE CHECK FOR $300 BUT SHE CASHED THE UNITED STATES POSTAL MONEY ORDER FOR $367.00 (THE TOTAL ORDER WAS $687.00). I TOLD HER THAT I WOULD RETURN THE COMICS FOR THE REFUND OF THE MONEY ORDER AND SHE WOULD HAVE ALL HER COMICS BACK AND I WOULD HAVE ALL MY MONEY BACK...SHE STILL SAID NO WHICH MAKES ME BELIEVE THAT SHE KNOWS EXACTLY THE GARBAGE THAT SHE IS SELLING AND DOES NOT WANT IT BACK! So we've got a clash of the ignorant and the malicious.
I don't mean "ignorant" in anger. This seller clearly has no knowledge in either comic grading or the comic market, but is throwing her(?) line out there anyways to see if she gets a tap. I don't think she's willfully going out to commit fraud or misrepresent her products, but she is making claims that she is not qualified to make when she refers to comics as mint. That is grading a comic and it is a good move on her part to remove such claims from future auctions. Clearly, her client is in the drivers seat on a lot of this and this fool thinks it is still 1993 appearantly. She has chosen to go more with her contracted client's wishes than what we all know (but she may not) is in the best interest of her potential customers.
I don't doubt her intentions are good - she wants to sell these items for her client, but she's dealing with a market that she doesn't know enough about.
I also am interested in how this cgcruler/comictoysandstuff debacle is unfolding. I would not be inclined to bid on either of their items after what has been shown so far.

If....IF....the buyer ctas had sent payment early on (the auctions ended Feb 10-ish) and received the books, and they were badly overgraded (which is clear they were), then the other buyer, cgcruler, could very easily not have sent payment yet, or just sent payment, and stopped payment "in time."Smashey wrote:the drama continues from the whole overgraded thingy.

So, in that case, even though cgcruler didn't receive any books, he may have felt that he dodged a bullet by stopping payment before getting stuck with overgraded books himself. So, even though the feedback wasn't accurate for those SPECIFIC books, cgcruler could very well have left them as "sympathy negs" for his associate, ctas.
Possible, and relatively likely....assuming that the buyers aren't conducting a scam (and the evidence for that is thin, at this time.)

Yes, in absolute terms, if cgcruler never received any books, the feedback for those specific books are completely false....but they aren't necessarily LIES, because they can be referring to his compatriot's situation. Remember, people are allowed to leave fb for any reason they like...

The payment part is fascinating...why did he pay $300 in a check and $367 in MO? If we can get the answer to THAT, we'll be able to determine if this was planned from the first bid.
And, of course, the "owner's" offer is complete garbage. No sane person would ever agree to such terms. It's a big "eff you" to the buyer. So, this seller's clearly nuts.

It's not 1973, after all, and when someone sells a comic for hundreds of dollars that originally sold for 10, 12, 15 cents, it is incumbent on the seller to gain a minimal knowledge of the subject PRIOR TO assigning recognized grading nomenclature without any further statement as to condition, and/or photographs which clearly show flaws.
As well, her whole "as is" repeated ad nauseum tells me her hands are not clean, either.
And, in the eyes of the law, when a person has "unclean hands", they lose a considerable amount of the "good faith" they may have otherwise had that would have helped them in a claim.
Her behavior after the fact....her refusal to take the merchandise back, her claims that the buyer is showing different books (why? What motivation would a buyer have to put up a different book if they received the correct book in good order, other than irrationality? You cannot just assume someone is irrational, without evidence), and her "offer" of "random comics" tells me that she....more than likely....knew exactly what she was doing, and DID intend, on some level, to misrepresent her merchandise.
There's no reason....ESPECIALLY after all this hoopla...to not take the merchandise back....UNLESS the seller is engaged in shady business herself, and knows she's caught. If she is concerned (highly doubtful) that she will be sent "different books" or the buyer will "further damage" the books....she should have taken much, much better pictures of her books before sending them out. Now, she cannot prove anything.
I've seen cases where a seller took pictures of an item that....coincidentally....left out the area that happened to be damaged, and which damage the plaintiff happened to notice when the item arrived. That seller, aka defendant, lost because of that, as well as the fact that the original shipping box was undamaged.
Her one saving grace, of course, is removing the condition nomenclature....but she really may not have had a choice.

Ya, Im having fun watching everything unfold.Regardless, this is fascinating stuff.
I think without a doubt he did receive overgraded books. I think the seller seems pretty shady with her no paypal, no return policy. Its obvious.
I dont think the two buyers are actually trying to scam. I think with his ebay auction to show some of the books, and how adamant hes being, he is truly a *SQUEE* off buyer.
I dont think those negatives from cgc were waranted at all though. If he ordered the books, then cancelled payment before they were even shipped, he has nothing he can possibly say about the transaction. There is no way for him to prove that the books he was going to purchase were overgraded. I think he himself should of received negatives for buying the books then cancelling the payment.
Comics negatives were waranted. Im not so sure on the coins that he purchased. That seems like retaliation on those. The coins dont have to do with the comics.

Dunno, Im gonna make a bag of popcorn and see what happens. I did notice that she is still receiving positive feedbacks. Some of the positives left are from ebay members with quite a few feedbacks. I wouldnt imagine experienced buyers/sellers to leave positives for books that cost $80 etc. I did also see a positive saying that it was not the condition stated, but was still a good book for the price, and he read "as is".
The plot thickens. Buyer left 2 more negs for the seller, increasing the amount of negs he left to 20. The other linked buyer had left 8 total, for a total of 28 for the month. The seller made her feedback private after those last 2.
Since her feedback has been private, she got 14 more negs, for a total of 42 for thew month. And they were not left by either of the buyers. So someone new left a bunch of negs.
Also the buyer is now claiming in his feedback left, that the seller is using shills to raise her positive feedback score.

A seller on eBay (or Craigslist, or Amazon, or whatever) cannot give a specific grade/condition to an item, and then hide behind the "sold as is" claim, if the item is clearly not IN that condition when it arrives to the buyer. That's fraud, and it's simply not allowed by the law.
The ONLY way "as is" is enforceable in a non-face to face transaction is if the seller gives NO comment on the condition in any way. Once they do that, "as is" is no longer enforceable. So, if a seller says "MINT CONDITION" and the thing is a rag, it doesn't matter if they scream "AS IS" from the rooftops: they lied and tried to commit fraud, so that term is unenforceable.

When a seller takes their FB private....which, by the way, is against eBay policy....that means they're hiding something.
This woman knows EXACTLY what she's doing; she took her FB private right after her last item sold. She probably TRIED to make it private before, but discovered she couldn't, with active auctions.
So long as her FB is private, she cannot sell.
