So this is probably nothing, but earlier today Warren Twitted this...

Fully possible they are just messing with us, but they know how hyper sensitive we can be over things like this. Thoughts?

Funny you should mention it. I noticed this last night and went looking for the full Perez artwork to see if there was more detail; unfortunately couldn't find it.

Morrison + Dysart + Kindt cooking up the most crazy and emotional and meaningful trans-time&dimensional-universe-wide event ever created. Of course, at the end of it three lost heroes from another Valiant Dimension cross over into the VEI universe... HAHAHAHA!

Left side, halfway down. Looks like he (or she) is wrapped in bandages. Not sure if the head in front (with the bandage) is connected (pun intended).

The topic has come up many times in the past, but to my knowledge, we've never been able to find out if they do outright own it or if there is some kind of grey area due to the ties to Solar that were created with the original Valiant.

Well, until someone uses Phil Seleski in media and it is brought to court by someone, no one will ever know. My guess is VEI feels like the risk is not worth the reward with that whole property, so just avoids the whole situation altogether.

I don't see any reason why VEI wouldn't own Seleski. Solar was never the gk3 solar phil just loved that character and took on the persona due to the simularities. VEI clearly owns the other characters Eyernal Warrior and Rai an both those were debuted in Solar and Magnus issues.

No, it's more complicated than that. Phil Seleski was "derivative" of the Solar copyright, owned by GK.
Derivatives aren't "all or nothing". They're "some parts this, some parts that".
Valiant certainly provided "some parts" of the Phil Seleski Solar. GK certainly provided "some parts" of the Phil Seleski Solar.
It's hard to see how either party could absolutely claim full ownership, but it's easy to see how both could claim "some parts".

They definitely own the idea of Phil Seleski. It's more murky if they could claim exclusive rights to the trademark of his name. If someone said they have an idea for a character who is "inspired by the Superman comics he read as a child", who ends up with all of Superman's powers and costume... it wouldn't matter if his name was Notclark McNotkent. That would be a problem for DC.

But phil seleski needs not solars exact power and certainly not his costume. VEI can simply be the alternate universe that happened sans phil seleski recreating it.
