I couldn't imagine them being able to use Phil Seleski, but I wouldn't put it past them to use the name in solicits in order to sway a few people to add the book to their pull lists, then wait for the call from Valiant's lawyers, issue a 'whoops' statement after FOC, and run the book as originally intended with Raymond Solar.
Wait - I can't recall - was Solar named Seleski in Shooter's Dark Horse version? If so, maybe the Seleski name ISN'T VEI's?

I don't know the full legality of the situation, but here's a thought...
Imagine this scenario:
You license just ONE property.
You tell a bunch of stories for that property.
You no longer have the license.
What would you own at that point?
Seems like one possible answer would be... you own nothing.

I would think you would own any new characters that were created, especially in the case of Solar. Magnus and Turok would be much messier, though. Solar (Phil Seleski) was NEVER the same character as the Gold Key Doctor Solar. They only licensed the name for use as the title, and some issue of the Gold Key Solar were shown in Seleski's house and noted as the reason he took on the persona of Solar. If through some legal hoopla, Dynamite is able to make the above argument, then VEI is in serious trouble as nearly nothing from VH1 could be used. As I said, either this is a mistake on Dynamite's part (most likely) or VEI is done as a company (not very likely IMHO).

I know I specifically asked Dinesh about Phil Seleski being used by VEI a long time ago.. but I think his answer was just his standard "Potentially".
It's not that I don't have an avatar... I've just been working on it for the last few hundred years.
