Dr. Eclipse in Dynamite's Solar?!

So I'm going to break my 8-year streak and actually post something useful. Marc Laming posted a finished inked cover today on Twitter that includes Dr. Eclipse (@monkey_marc on Twitter) in the new Solar series for Dynamite. So if you read this post Dino, do you not own characters that were introduced in the Solar book? I would post the picture but me not so smart.

I'm not sure how it makes any sense that the characters created out of the Valiant years would be gold key property. We need our Mothergod especially.

Wow, you can't really get closer to VE1 than that. I'm not defending Dynamite in this, but there may have been some deal with VE1 and Random House where (That's who owns them, correct?) any character created in that series become property of Random House.

Either way, they should have created their own version of the character to prevent sure an obvious possibility of copy right infringements.

I really hate supporting Dynamite, but it's shady dealings like this that make me not want too. My love for the Gold Key characters will keep me with them for the time being, which is almost unfortunate. I have enjoyed MOST of what I've read so far as I really enjoy all of the writers on each book. I'm also happy to have new stories about these characters out there regardless if it's with Valiant or not. With that said, prior to Dynamite I would have said "Anyone BUT Dynamite...". Nothing we can do about it now except hope that Dynamite looses interest in these characters soon and eventually ends up with VEI in the future.

It is possible that VEI gave them permission, but I think it is highly doubtful. I know I wouldn't. I'd keep my IP as close to the vest as possible. Don't know the whole story, but I hope VEI's lawyers sue the *SQUEE* out of dynomite.

If valiant bring forth legal action (if it does get printed) and they win the case, are their legal fees paid for as part of the losing parties infringment on valiants copyright or IP?

Not meaning to answer for Dino, but have a possible clue. The copyright notice in the old Valiant books separated the copyrights for characters that originally appeared in books originally published by Western, and all other characters (with the latter belonging to Valiant).

Because if they let them use Dr. eclipse without permission, what's to stop someone from using XO or Bloodshot?

If it's their legal property, they are obligated to address it whether they ever plan on using the IP or not.

No different than suing Kirkman over Outcast.

I don't think Kirkman had any clue about V2 Outcast - he wasn't trying to profit off of some existing fanbase for an Outcast title that no one heard of

Like you said ... what would stop them from using other characters? I'm guessing the argument they would make is that these were characters(erika peirce/dr. eclipse) that were first introduced in Solar and key characters in terms of Solar's VEI origin and arch nemesis therefore they are now gold key property Very strange ...

There is also the issue of derived works, but that would be a hell of a derivation.

This does seem like DE over-reaching, to say the very least, but of course the devil would be in the contractual detail(s), which I guess only 3 organisations are really party to.

Glad I never bought any new books from Dynamite now. This is ludicrously unprofessional behavior. I will be extremely surprised if VEI do not own the rights to Dr. Eclipse.
