was going on what Greg said...k_c_collectibles wrote:As long as they are just "applied for" This is a section of the article on Newsarama:myron wrote:easy Chris...they APPLIED for the names...doesn't mean they have them or will even get them...
In checking on the status of the trademarks of the former Valiant characters, Newsarama learned that 12 of them, as well as the term “Valiant” have been acquired by Valiant Intellectual Properties, LLC, a Delaware-based corporation. Trademarks now owned by Valiant Intellectual Properties include: Secret Weapons, Outcast, Rai and the Future Force, Deathmate, Quantum and Woody, Harbinger, Punx, Dr. Mirage, Eternal Warrior, Ninjak, Bloodshot, and The Visitor.
Maybe they do not have all the facts straight, but last I knew acquired meant you had something. It does not say anything about applying for there.
Sorry about my rant - I am HAPPY AS HELLthat John won the auction. But then I read this article and my warm fuzzies started going away...
It is a GREAT day for the Valiant fans across the world!!!
Why waste time learning, when ignorance is instantaneous?

If that's the case, then they could theoretically make a title like... I dunno, Valiant Universe or whatever and still be able to use the names of the characters within the book?Todd Luck wrote:I'ld wait and see what Taddeo posts before I got to worked up over this one guys. Manof theAtom hit it on the head, trademark refers to a brand name only (the title on the cover in this case). The actual characters/concepts have seperate rights (intellectual copyrights).ManofTheAtom wrote:Two of which are core books.riftt wrote:^^^ hmm, the only loses there are bloodshot, eternal warrior, and harbinger
I believe this is similar to DC's Captain Marvel and Marvel's Captain Marvel.
Taddeo can do a comic with Gilad Anni-Padda but he can't call it Eternal Warrior, he has to call it something like "The Immortals" or something like that, just like DC can do a Captain Marvel comic but can't call it Captain Marvel.
One example I can think of: Hasbro had a problem with reissuing 80's Transformers under their original names (ie Bluestreak, Hot Rod) but Dreamwave's comics were able to use said names within their comic since the comic was called "Transformers." Would this be similar?

I would say that Newsarama has it wrong if they believe the trademarks are a "done deal".k_c_collectibles wrote:Maybe they do not have all the facts straight, but last I knew acquired meant you had something. It does not say anything about applying for there.
This is the official information from the US Patent & Trademark Office:
http://tarr.uspto.gov/servlet/tarr?regs ... y=78598923
Particular emphasis on:
"Current Status: Newly filed application, not yet assigned to an examining attorney."
The Trademark Search Engine is a bit confusing, since it LOOKS like people
own a trademark when they have only applied for one.
Current Status of any trademark is the official "word"...
not the fact that it shows up in the search engine.
(Sorry to sound harsh, I'm indirectly making a statement to Newsarama here.)

VH 1 all the way.
There's no rule that says that Solar, Turok, or Magnus have to be published or referenced for the other titles to exist.
When Buffy moved over to UPN, Angel couldn't make any references to her by name but that didn't stop them from making references to what happened in episodes of that show.
A Harbinger comic book they can make references to how Kris gave birth to a child and then had to send it to the future, which is a completely original VALIANT idea that has nothing to do with Gold Key's rights for Magnus.
Taddeo could have Magnus change his name and still keep his past history intact, a la Barbara Gordon changing her name to Oracle, or Dick Grayson changing his name to Nightwing.

They got me ALL worked up in case you couldn' tell...greg wrote:I would say that Newsarama has it wrong.k_c_collectibles wrote:Maybe they do not have all the facts straight, but last I knew acquired meant you had something. What Do You Call A Bloodshot Comic When You Don't Have...
... the trademark?
Easy, call it by its original name, Rising Spirit

I say that the Valiant characters be a separate subdivision of Assassination Entertainment with all the characters there under the Valiant umbrella. Once both universes are publishing monthly books there would be crossovers from one universe to the other. Hell, I wouldn't really care if there was only one universe as long as the Valiant ones are printed!!! John makes the call as he has the rights to the characters!
The only thing I liked from VH2 was Quantum and Woody so why not make them a part of the VH1 reboot? References can be made to Magnus, Turok and Solar, but not by name like MOTA said. Not a real big deal. Just work with the present day characters for now... that gets rid of the need for Magnus. Turok is off playing in the lost land with the dinosaurs. Solar is, well, off chasing spider aliens many, many light years away. That way they can be brought back into continuity some day if John somehow acquires the rights to them.
Just my thoughts. A VH1 reboot with Quantum and Woody!!!

Exactly.
And you can still respect the end of VH 1.
Magnus is lost in time, Turok is in the Lost Land, and Solar merged with a sun.
One day, when Taddeo gets the rights to those characters, they can be brought back into continuity.

Can you have a character named "Magnus Torkelson"?ManofTheAtom wrote:VH 1 all the way.
