Remeber though that Jim Lee was an integral part of Deathmate and he now works for DC. He also did the Hard Corps #1 cover. So anything is possible. :screwy:

Is it possible DC is using VIP as a front? VIP could be more than some random lawyer and a few businessmen

No. I don't think so. DC is a comic book publising company. They actually produce comics. VIP is nothing more than a phantom business set up to legally extort some money from VEI for copyrights. DC doesn't roll that way.

I wouldn't get too worked up about the rumor anyway, I sincerely doubt there is any truth to it.

If DC wanted Valiant they would have shown up at auction & bought it. Valiant was sold for an amount, one would assume, that DC would have had no problems exceeding if they wanted the universe.

Also, I highly doubt VEI would allow DC to reprint material since VEI is currently producing their own reprints in HC.

I will too. It is the only thing some businesses understand. "Dear DF, I will no longer be buying any of your comics. Here is why..." The real power would be in finding out who it is before they force some kind of settlement from VEI. Then we could maybe get them to drop this nonsense.

Er, VEI are the ones that were wronged, so VIP will pay them to settle, not the other way around.

VIP doesn't have anything that VEI wants or needs that would requiere them to pay them anything.

VIP is delaying VEI's relaunch with their BS legal maneuvers which costs VEI time & money. VIP is hoping that VEI eventually will pay them to dismiss their claims and go away.

Well, no, not really.

VIP released an ashcan at SDCC and it was VEI that responded with a lawsuit.

VIP hasn't used the law in any way, shape, or form to hinder VEI. On the contrary, VEI is using the law to go after VIP, who has to defend its release of the ashcan, a product that violated VEI's copyright and trademark.

VEI (the real VALIANT owners) are the ones suing VIP (the fake VALIANT), so if anyone is going to pay anyone else to dismiss a lawsuit, it'll be VIP paying VEI, not the other way around.

Yeah, MOTA. No insult intended by me either.

Here is how I see it. VEI bought the rights to all the characters in a legal auction. VIP filed a claim to various character names such as "Harbinger." They have no legal right to the Valiant characters like Harbinger but they are asserting that VEI cannot use the name "Harbinger" and other Valiant names like Rai & Bloodshot.

The SD ashcan published by VIP is a lame attempt to try and assert that they have some interest in actually using the names they allegedly trademarked to publish some books with non-Valiant characters in the future. However, I believe that they are only claiming the names to try and force VEI to "buy" them from them so any blocks to VEI's relaunch are removed.

Kind of like the guy who registers the domain name like microsoft.com and then tries to sell it to Microsoft for big money. He isn't planning on really using the site himself, his only interest is in selling it for as much as he can.

And that's the thing.

VEI didn't react to VIP's use of the ashcan with an offer to buy the TMs from them or pay them to back away from them. They reacted with the most American of things, a lawsuit (which unlike most lawsuits in this case is a rightful one).

VIP trampled over VEI's rightful trademarks, opening themselves to a lawsuit.

In a system where Marvel can sue Defiant over the use of the word Plasm because people might confuse it with Plasmer, VEI has the better footing despite Acclaim's abandonment of the trademarks.

Well, that's where VIP *SQUEE* up, because they went beyond the intent that you describe. They not only (to continue the analogy) "bought the microsoft domain" name, but they set up a "website" that claimed that they were the real "Microsoft" and tried to pass off their product as being genuine "Microsoft" product.

That's what opened the door for VEI to file the lawsuit.

MOTA,

I actually think that both sides are suing each other. I could be wrong but I think the first legal maneuver was by VIP to prohibit VEI from using the character names that VIP claimed they had trademarked. That put a legal cloud over VEI's relaunch. I suspect that VIP then began negotiating with VEI over a price to drop the injunction and sell whatever rights VIP has to names. And I think VIP sued, or threatened to sue, over the release of the Harbinger HC.

In a case like this, the person who is alleging that they own the names (VIP) is required to demonstrate that they actually intend to use the names, otherwise their claim will lapse. The "publication" of the SD ashcan was no doubt motivated by that legal requirement. Once VIP used those names in the ashcan, VEI was obligated to sue or it would appear they were conceding to VIP's claim of ownership.
