Edit: What I mean is if they never get the book in (which I think is likely) you won't really be out anything.

Amazon is still listing a lot of books that are no longer available (OOP); e.g. Book of Death Deluxe. You can order them and then you will receive an automated email every 2 or 3 months saying the item is currently not available. Like Jeremy mentioned Amazon doesn't charge upfront so there is no harm in trying.
