It comes from Solar 3 (or was it 4?). costumed Solar fought phil and the fight ended with a huge explosion in the arctic. Months later in an editorial bob layton said that the fight killed all the penguins in the arctic hence the phrase "there are no penguins in the Valiant Universe"

If nobody else is going to say it, I will. Penguins are not confined solely to cold habitats or the Antarctic but they are confined to the Southern Hemisphere.

Luckily, it was the southern hemisphere in Antarctica where Phil Seleski confronted the Solar that manifested from his mind so the penguin genocide still probably happened, albeit not so totally as represented by Bob Layton.
