I don't want to change the subject from Shocker Toys, but do you think that VEI would have the same issue with Diamond if they were to put out an X-O book? regardless of what title was being published. That's part of VIP's "contention"
with VEI... both companies believe they deserve the "Valiant" label.
My guess is that VIP will cause whatever problems that VIP can cause
because they don't seem to be able to do much of anything else.

Back to the Shocker Toys issue... they seem to be interested in creating
toys for independent publishers which are already recognizable to fans.
From that standpoint, the copyrights are all that matter. The way the toy looks
is 100% dependent on the copyrights.

I could be wrong, but I would think without the trademarks, you couldn't put the name of the character on the packaging, which might be a bit of a problem.greg wrote:

"Gilad the Immortal" or "The Original Eternal Warrior" on the packaging.
I doubt if that would be much of a problem.

Do you remember the two Ghostbusters toons from the 80's? One was Filmation that owned the Ghost Busters trademarks, while the other was by DIC, who made the toon based on Columbia's Ghostbusters movie.greg wrote:"The Original Eternal Warrior"

I agree with Greg names can be changed but symbols are a tough one. Like Dr. Solar we were told Classic Media owns both versions green and flesh tones as the rights went back to them. A statue made through Classic by dynamite has flesh tone thats what we modeled the shockini after. We would love to add the Valiant characters to the line whenever the new owners decide to do toys.

I would love to see the original agreement between Western and Voyager. There must be a bunch of border-line issues what belongs to whom. It is generally very strange that a derived creation would revert together with the licensed product. Sun sure has no rights to the products I create with their tools. I was a kid so to me the "real" Ghostbusters were the ones from the live action movies and so their cartoon shows were about the "real" Ghostbusters, when I was a kid I thought that Filmations' Ghostbusters were a poor man's knock off of the real Ghostbusters that Columbia made.

I thought the same. I even thought that Jake and Eddie were Peter and Ray's kids. If you are asking why it takes so long it is because things have to be done properly. We did not want to rush the line and SCUD's creator understands that as do the rest. Your welcome buddy, we just defended ourselves oh wait we are not allowed to do that. We should just remain quite like Mattel and Hasbro and not listen to the fans. Actually that is a good idea because most of the people on the net just talk crap so there is not much to listen to.
